ALL ABOUT BIOMETRIC INFORMATION AND PRIVACY

Presented by Lisa Handler Ackerman of Wilson Elser’s Chicago office, this Lunch & Learn will provide an overview of the Illinois Biometric Privacy Act (BIPA), which is currently the only state law protecting biometrics containing a private cause of action thus leading to surge of class action litigation arising under the Act.  The discussion will cover the specific legal issues litigated under BIPA, including: the Illinois Supreme Court decision Rosenbach v. Six Flags, which held that a plaintiff does not need to suffer actual harm to be “aggrieved” and entitled to pursue a BIPA claim; interpretation of the Act’s imposition of liquidated damages “per violation;” and liability for private entities such as Facebook, Shutterfly and Google; employers; and biometric time clock vendors.  Finally, the discussion will review coverage issues for BIPA claims tendered to carriers under general liability policies, management liability policies, and cyber policies.
