LUNCH & LEARN: A CASE STUDY IN HIGH EXPOSURE TRUCKING LOSS (Webinar Attendance)

Seeing a severe liability claim from cradle to grave gave all attendees a whole new perspective as to what drives a claim’s value.   Stuart Miller of Wilson Elser gave an excellent case study of a high exposure trucking loss all the way through verdict.  The audience saw case strategy, mock trials, mock jury deliberations, real jury selection and trial issues and a post-mortem on the actual verdict.

This latest webinar will be presented by Robert W. DiUbaldo, a Shareholder of the firm of Carlton Fields P.A., and who is an acknowledged expert in this area. He will update us on the absolute current situation in this rapidly developing area.

The emergence in recent years of so-called “reviver statutes” reopens and extends the period under which claims alleging sexual abuse, molestation or assault may be brought against perpetrators and the institutions or entities that employed, supervised, retained or harbored them.  As a result of certain states passing reviver legislation, thousands of claims previously barred by statutes of limitations have now been resurrected against insured entities and/or individuals.  The surge of previously time-barred tort claims presents significant new exposure for various classes of insureds and long-expired insurance policies and reinsurance agreements.

These developments are of particular interest to insurers/reinsurers/financial entities including those with legacy long-tail liabilities.  The webinar should be of particular interest to claims, legal, actuarial, underwriting and financial professionals.

IMPORTANT 2020 UPDATES IN ARBITRATION LAW

Michael S. Davis & Yoav M. Griver, Partners and Bruce S. Goodman, Of Counsel,of the Zeichner Ellman Krause LLP firm will provide a comprehensive update of activity in 2020 only so will be of interest to all engaged in arbitration, alternative dispute resolution or claims disputes generally.

Yoav Griver represents ZEK insurer clients in arbitrations and in court cases where arbitrability, and the appointment of arbitrators has been at issue. Prior to joining ZEK, Yoav was Litigation Counsel to Weil, Gotshal & Manges LLP, where he litigated a variety of commercial and intellectual property matters for clients in the banking, credit, transportation, insurance, computer software and electronic industries. Bruce Goodman  is Of Counsel in the Firm’s New York litigation group. Bruce focuses his practice on commercial litigation, and related matters. Bruce has helped spearhead the firm’s representation of Israeli corporate clients. In Tel Aviv, in February, 2005, Bruce and Stuart Krause addressed the Association of Corporate Counsel in Israel on the topic of “International Arbitration and Mediation.”

PCS has noted the phenomenon that catastrophe losses seem to be getting larger and more frequent.  Mr. Johansmeyer will discuss PCS’s observations that in recent years political risk indicators, such as post-event legal and regulatory actions, have played a factor which has, and likely will, impact future insurer/reinsurer risk and capital management decisions.

The number of catastrophe events  designated by PCS®, a Verisk business™, in the United States has reached record-setting territory every year for the past five years. And the number of events reaching an industrywide loss threshold of at least US$1 billion has reached record levels in 3 of the last 4 years.

Tom Johansmeyer runs PCS, a Verisk business.  Under his leadership, PCS has expanded from North America to Japan and Asia Pacific, Latin America, and Turkey.  Tom also launched PCS’s foray into global cyber, marine and energy, terror, and large property risk losses.  Before PCS, Tom held re/insurance industry roles at Guy Carpenter and Deloitte.
